Welcome to Lush & Lit Candle Co. (“Lush & Lit,” “we,” “us,” or “our”). By accessing or purchasing from lushandlitcandle.com (the “Site”), or from our related sales channels (pop-ups, social links, affiliate referrals), you agree to the following Terms of Service (“Terms”). Please read them carefully.

If you do not agree, please do not use the Site.

 

1. Online Store Terms

By using our Site, you represent that you are at least the age of majority in your state or province, or you have consent from a parent/guardian. You agree not to use our products for any illegal or unauthorized purpose, and not to violate any laws in your jurisdiction (including, but not limited to, copyright laws).

 

2. Handcrafted Products & Availability

All of our candles and wax products are hand-poured in Georgia in small batches. Natural variation in color, minor surface texture differences, or scent intensity between batches are normal and not defects.

We reserve the right to limit quantities, discontinue scents, or update formulas at any time.

3. Processing & Shipping

 

Processing Time: Orders typically ship within 7–10 business days (Mon–Fri; excludes holidays). During launches, promotions, or high volume periods, processing may extend slightly. We’ll notify you if delays occur.

Shipping Methods: We primarily ship via USPS, UPS, FedEx. Transit time is typically 2–5 business days after your order leaves our studio, depending on destination and carrier volume.

Tracking: You’ll receive a shipping confirmation email with tracking once your order ships. Didn’t get one after 10 business days? Contact us at [EMAIL].

Lost / Stolen Packages: Once a package is marked Delivered by the carrier, we are not liable for loss or theft. We’ll gladly assist you in filing a claim with the carrier and, when possible, help with a discounted replacement.

 

 

4. Shipping Address Accuracy

Please double-check your shipping address at checkout. Orders returned to us due to an incorrect or undeliverable address may require additional shipping fees to reship.

 

5. Returns, Exchanges & Damages

Damaged in Transit? Email photos of the damaged product + packaging within 5 days of delivery to Lushcandle@Lushandlitcandle.com so we can assist.

Because candles are consumable and custom-poured, many items are final sale unless damaged or defective. See refund policy for details.

6. Heat Sensitivity & Seasonal Shipping

 

Soy candles and wax melts can soften or sweat in extreme heat (common in summer shipping). This does not affect burn performance. If a product arrives softened, allow it to cool and re-solidify at room temperature before use.

 

 

 

7. Product Use & Safety

 

Always follow candle safety:

• Burn within sight & keep away from drafts, pets, children, and flammables.
• Trim wick to ~¼ inch before lighting.
• Allow full melt pool on first burn for best performance.
• Do not burn more than 4 hours at a time.
• Stop burning when ~¼ inch wax remains.

Misuse of candles or failure to follow safety instructions may result in fire hazard or injury; by purchasing, you assume responsibility for safe use.

 

 

8. Pricing, Promotions & Changes

 

Prices are shown in USD and may change without notice. Promotional codes, affiliate links, bundles, or discounts may not be stackable unless specifically stated. We reserve the right to correct pricing errors and cancel orders affected by obvious mispricing.

9. Affiliate & Referral Links

We offer an affiliate program where registered partners earn commissions for qualified sales made through their unique referral link or code. Affiliate payouts, eligibility, and tracking are governed by our Affiliate Program Terms (if you publish a separate page, link it here: /pages/affiliate-terms). We reserve the right to approve, pause, or terminate affiliate accounts at any time.

 

 

10. Accuracy of Billing & Account Information

 

You agree to provide current, complete, and accurate purchase and account information for all orders placed with us. You agree to promptly update your account and other information, including your email and shipping address, so we can complete transactions and contact you as needed.

 

11. Optional Tools & Third-Party Apps
We may provide access to third-party tools (like payment, tracking, reviews, or affiliate portals) over which we have no control. You acknowledge access is “as is” and “as available” without warranties. Your use of such tools is at your own risk and subject to the third party’s terms.

 

 

12. Third-Party Links

Some content, products, or services available via our Site may include materials from third parties. We are not responsible for examining or evaluating third-party content and will not be liable for any harm related to those sites or services.

13. User Comments, Reviews & Submissions

If you submit reviews, photos, testimonials, or social content tagging @lushandlitcandle, you grant us a nonexclusive right to share, repost, edit for length/clarity, or feature it in marketing (crediting you when applicable). Please do not include personal or private info in reviews.

14. Personal Information

Your submission of personal information through the store is governed by our Privacy Policy: /policies/privacy-policy (update link as needed)

15. Errors, Inaccuracies & Omissions

Occasionally there may be information on our Site or in the Service that contains typographical errors, inaccuracies, or omissions (including descriptions, pricing, availability, or shipping times). We reserve the right to correct, update, or cancel orders affected by such information at any time without prior notice.

 

 

 

16. Prohibited Uses

 

You may not use the Site or its content:

(a) for unlawful purposes;

(b) to solicit others to perform illegal acts;

(c) to violate regulations, rules, laws, or local ordinances;

(d) to infringe or violate our intellectual property rights;

(e) to harass, abuse, or defame others;

(f) to upload viruses or malicious code;

(g) to scrape data without permission.

Violation may result in account termination.

 

17. Disclaimer of Warranties

We do not guarantee that the Site will be uninterrupted, timely, secure, or error-free. Products are provided “as is” without warranties beyond those expressly stated by us or required by law.

 

 

 

 

18. Limitation of Liability

To the fullest extent permitted by law, Lush & Lit Candle Co., its owners, employees, and contractors shall not be liable for any injury, loss, claim, or indirect, incidental, punitive, or consequential damages arising from product use, delayed shipping, or Site use. Where direct liability applies, it is limited to the amount you paid for the product at issue.

19. Indemnification

You agree to indemnify and hold Lush & Lit Candle Co. harmless from any claim or demand made by any third party arising out of your breach of these Terms or violation of any law or rights of a third party.

 

20. Severability

 

If any provision of these Terms is determined unlawful or unenforceable, the remainder remains enforceable.

 

 

 

21. Termination

 

These Terms remain in effect unless terminated by either party. You may stop using the Site at any time. We may suspend or terminate access (including canceling or refusing orders) if we believe you have violated these Terms.

22. Governing Law

These Terms and any sales transactions are governed by the laws of the State of Georgia, USA, without regard to conflict of law principles, unless applicable federal or Delaware corporate law requires otherwise.

23. Changes to Terms

We may update these Terms at any time. Changes take effect when posted on this page. Continued use of the Site after changes means you accept the revised Terms.
